Supervisor Teed called the Regular Meeting to order at 7:00 PM.

Councilman Beechler led the meeting with the Pledge of Allegiance.

Public Participation
|
MR. JOHN DUCHESNEAU asked that there be a moment of silence for Dan Owens
who recently passed away. Mr. Owens served the Town and the community for many
years.
Mr. Duchesneau distributed a list of questions to the Town Board. The Board addressed
the 5 questions that related to the Melvin Hill Water District.
MR. ROBERT OAKS discussed the May Town Board Meeting Minutes. He also inquired about the FOIL Request he had faxed to the Town Hall. Mr. Oaks commented on the Town of Phelps Zoning Officers.

Approve Minutes of June 5 & July 10, 2006 and Special June 8 Board Meeting
|
Supervisor Teed asked for a Resolution to approve the June 5, 2006 Regular Town Board
Minutes that were tabled, the June 8, 2006 Special Town Board Minutes, and the
July 10, 2006 Regular Town Board Minutes. Councilwoman Day, offered the following
Resolution. RESOLVED that, the tabled June 5, 2006 Town Board Meeting Minutes be
approved as amended and the June 8, 2006 Special Town Board Meeting Minutes and
the July 10, 2006 Regular Town Board Meeting Minutes be approved as written. The Resolution was seconded by Councilman Dole, who moved the adoption. 5 AYES. Motion carried.

The Town Clerk’s July 2006 report was reviewed by the Board Members for their approval.

Discussion With the Supervisor
|
- Supervisor Teed asked the Board if they had reviewed the proposal from Anderson
VanHorne Insurance Agency regarding the additional insurance for the Highway equip-
ment stored inside the Town Barns. Supervisor Teed said we have to address this very
soon.
- Supervisor Teed discussed the Water and Sewer Rates. He said we tried to compare
with other municipalities but that has proved to be impossible. He said every municipality has a different formula for computing the bills. He said the Town of Geneva has a different rate for each water district. He said we will continue to work on
these rates.
- Supervisor Teed said one of the things we discussed last month was paying for Mike
Vienna’s water license. He said he went back into the files and found out that the Town did pay for Kurt Owens’ “C” water license, so there was no precedent set by paying for Mike’s “D” water license. Supervisor Teed said Kurt had implied that he had paid for the licenses, but upon checking he found out the Town did pay for the “C” license.
- Supervisor Teed said the Town had previously been paying an exorbitant amount per
minute for long distance service. He said Bookkeeper Barb Middlebrook brought it to
his attention. He said Barb did some research and got the bill down from $400-$500 per month to $170 this month. He said Ontario Telephone would like our long distance business and Barb is currently negotiating with them to possibly obtain even a lower rate.
- Supervisor Teed said he had some information regarding the old Court House. He
said he contacted Ontario County and was told the way it is done at the County is through auction. He said they use Reynolds Auctioneering Service of Newark, NY. Supervisor Teed said we first need to do a Board Resolution to declare the property a surplus property, no longer needed by the Town. There was lengthy discussion regarding the property.
Councilman Dole offered the following Resolution. RESOLVED that, the Town of Phelps declare the old Phelps Town Court, 77 Main Street, Phelps, NY surplus property and consider putting the property up for auction, provided we can set a reserve amount on it. The Resolution was seconded by Councilwoman Day, who moved its adoption.

Next Town Board Meeting
|
Supervisor Teed announced that because of the Labor Day Holiday, the September Board
Meeting will be held on MONDAY, SEPTEMBER 11, 2006, at 7:00 PM at the Phelps
Town Court Meeting Facility, 1331 Rt. 88, Phelps.

White Road Water
|
Councilman Beechler asked if we could discuss the White Road Water. Supervisor Teed said White Road Water is another water district issue that we are going to have to address in the near future. He said we had a break on that line, luckily it was not in the creek. He said the break was 10 feet outside the creek so we were able to find it. He said he has sent letters to all the residents in that district regarding the fact that there has never been a maintenance fee applied to that district, so we have no money to pay for repairs. He said Bookkeeper Barb Middlebrook informed him that in the last quarter, the money we paid for water and the amount collected from the residents for water usage was $400 short. Supervisor Teed said this was a losing proposition. He said if the residents wish to have a Water District established, they will have to petition the Town to move forward with the district.

Executive Session
|
Supervisor Teed asked for a Resolution for the Town Board to go into Executive Session
with the Town Clerk in attendance. Councilman Dole offered the following Resolution. RESOLVED that, the Town Board enter into Executive Session at 8:30 PM
to discuss the sale of the old Phelps Town Court House. The Resolution was seconded by Council-woman Day, who moved its adoption. 5 AYES. Motion carried.
Councilwoman Day offered the following Resolution. RESOLVED that, the Town Board come out of Executive Session at 8:50 PM. The Resolution was seconded by Council- man Dole, who moved its adoption. 5 AYES. Motion carried.
Supervisor Teed called the meeting back to order at 8:50 PM.
Councilwoman Day offered the following Resolution. RESOLVED that, the old Phelps Town Court House at 77 Main Street, Phelps be put up for auction, with a reserve amount in place. The Resolution was seconded by Councilman Mattoon, who moved its adoption.
